This isn't about not being able to make an informed decision. This is about someone with a declared bias then being biased.

Mrs Bercow is impartial. In fact she seems very accommodating.

But the judges didn't pass an opinion on Brexit they only passed an opinion on whether the pro-roguing of parliament was legitimate. As such the referendum result had absolutely no bearing on how they should have made their ruling.
A parliament that cannot reach an agreement over Brexit is not anarchy by any stretch of the imagination.
I also see no evidence of any upcoming totalitarianism. Though anyone worried about that should be reassured by the judiciary showing that they still have power over the Government to ensure that they obey constitutional law.
With the likes of Brendan O'Neill yearning for leavers' riots and Dominic Grieve suggesting our PM could declare a state of emergency to enable his crash out no deal Brexit, it may be not so much fantasy as something being deliberately set in motion.
There is a big difference between political agitators calling for riots and there being any prospect of riots. It will be interesting to see if Boris really can use emergency powers when there clearly is no national emergency. It would not surprise me if that will be another decision that goes to the Supreme Court. I assume that there must be some constitutional limit to stop a PMs using emergency powers to force through their agenda without the support of Parliament?
