The law states that as the car has been repaired although unsuccessfully you are still entitled to a refund although the dealer could deduct a sum for 'fair use'
The 30 days the dealer offered is one thing although don't be fooled by their interpretation of your rights.
If you went legal, you'd probably win as you can prove there was a fault as they had tried to fix it although this isn't really necessary
You need to be firm, put it in writing telling them that they have a final chance to fix the air conditioning fault or you will reject the vehicle. You HAVE to stop using it now though, if you pile on the mileage they would argue that the fault is not preventing you from using the car and would use the mileage since sale to prove this. |
