The law states that as the car has been repaired although unsuccessfully you are still entitled to a refund although the dealer could deduct a sum for 'fair use'

The 30 days the dealer offered is one thing although don't be fooled by their interpretation of your rights.

If you went legal, you'd probably win as you can prove there was a fault as they had tried to fix it although this isn't really necessary

You need to be firm, put it in writing telling them that they have a final chance to fix the air conditioning fault or you will reject the vehicle.  You HAVE to stop using it now though, if you pile on the mileage they would argue that the fault is not preventing you from using the car and would use the mileage since sale to prove this.

Hopefully the vehicle is already conditionally rejected in writing. If it isn’t do it now I suggest. They are still fixing the originally reported fault so they can have another go at that. If they start to get shirty about their 30 day warranty tell them clearly you aren’t using that.

Edit - to be clear you are using their warranty if they are happy to do that and take it back no wear and tear.

Nothing in writing as of yet.

The warranty that the repairs are being done under is a third party one.

They are claimng all repairs through this which is why it's taking so long to sort out.

Mrs gonna tell them on Monday that if car isn't repaired next week  then we want full refund  including the money spent on new cam belt snd water pump  which we wouldn't have paid for if not buying the car .

I have never felt so messed around by a company in my life, never ever buy a car from these people....

Am I allowed to put the name of the company on here To warn people off of them?

Well,

Looks like they are going to fix it this week.

The Mrs has phoned both the dealer and garage, and its going back in on Thursday , with a view to it being ready by the weekend. Ill believe it when i see it but what the hell.......

So another update.

Car went in on Thursday . Part still not arrived .

Looks like no chance of being done untill Monday  which means we could have kept the car over the weekend !

Had enough now and a formal letter has been written rejecting the car if not ready by Monday evening .

I shall be hand delevery it my self .

Never been messed around like this by a company in my life ...

Update.

Part arrived, fitted today, still not working.

Went over yo get money back but car locked away in the mechanic building so couldn't retrieve personal items .

Dealer says garage didn't tell him not working still.

Spoke to him face to  face, told him he has untill Monday eve to sort out .......
