What tests? I could take out a private prosecution with you over libel. It doesn't mean you have done it.

Somebody PLEASE give Sonic £20,000!
As for this case - it's hilarious and it's so good to see the rich and powerful squirm for at least, oooh, five minutes before their expensive lawyers justify their massive fees.
The simple trick to appearing in court is deny everything, even I know that and I'm not on £1000 an hour!

He said we give £350 million to the EU, but missed out the rebate brings it down. I know what he said. I don't know if you notice, I post on here sometimes...

Will Tony Blair be wheeled out next for lying about the Iraq War?

I note legal action is busy right now.
Tice Suing SNP MEP For Libel -
Brexit Party Chairman Richard Tice has issued a legal letter to SNP MEP Alyn Smith, for calling the party “a money laundering front” on live television. They demand that by midday tomorrow Smith must issue the following (surprisingly reserved)statement otherwise High Court proceedings will be brought “for appropriate relief”:
“On 27 May 2019 I was interviewed by Sky News. In that interview I stated that the Brexit Party and by implication its Chairman, Richard Tice, were involved in money laundering. Having reflected upon this, I am happy to state that in fact I do not have any evidence to support this allegation. I spoke in the heat of the moment and did not give proper consideration to the implications of what I was saying. Neither the Brexit Party nor Mr Tice are involved in money laundering. I am happy to set the record straight “

This is what the case is about, he knew the 350 figure was wrong and used it to deliberately mislead the public data:image/gif;base64,R0lGODlhAQABAIAAAAAAAP///yH5BAEAAAAALAAAAAABAAEAAAIBRAA7
The case was reviewed to understand if there is a potential case, because you don’t want anything that would fall at the first hurdle going to court

I guess it's up to the Judges to decide if he deliberately misled voters during the campaign?

Let's look at the wording on the bus.
"We send the EU £350 Million a week" (Yes we do, however, the returned rebate of £100 million, although ambiguously missing, does not negate the veracity of the initial statement, it states we send, not we spend).
"let's fund our NHS instead". (This is clearly a "suggestion", it is in no way suggesting exactly how much we would be funding the NHS instead, it is just offering a rallying cry to suggest that more money would be available for projects such as the NHS. Anyone who made the gigantic leap to believe that £350million extra would be spent on solely the NHS needs to check themselves in to an NHS noggin inspection establishment).
This case will be thrown out as soon as the lawyers have bled the funds dry.

I know the history and numerous discussions for/against.The judges, I assume, will look at the financial facts regarding rebates etc and whether we actually do send £350million to the EU and if the slogan was interpreted as such, hence misleading.
I don’t think it’s worth us going over it all again here because it’s been done to death already.

If it's just a case of using numbers in a devious way to mislead peeps during the campaign, they'd all be in the dock.
MP's do it all the time to suit their story.
Still, if it stops Boris becoming the PM, their main objective will be haddata:image/gif;base64,R0lGODlhAQABAIAAAAAAAP///yH5BAEAAAAALAAAAAABAAEAAAIBRAA7data:image/gif;base64,R0lGODlhAQABAIAAAAAAAP///yH5BAEAAAAALAAAAAABAAEAAAIBRAA7
