Well, I'm not saying they should personally, but tapzilla is claiming that the Magna Carta guarantees everyone access to justice, and that if someone has to pay to access justice then that makes it unlawful.

I've asked him to explain how having to pay money to take the NHS to court is ok, but having to pay money to take an employer to a tribunal is apparently unlawful.

Still waiting for an explanation.

And as I said it does not rule out court fees, just access to the Justice system without delay. As far as legal aid goes ? That's been cut to the bone and really isn't what it once was.

Ask the Politicians who set the rules for legal aid. Laywers have to be paid, if you like it or not.

Still waiting for you to read Professor Dicey's work on the Constitution.

You have to look at all of these cases, then figure out who won and who lost to form a balanced view (the data is out there). The Human Rights Act and a whole slew of other laws are what protects us all from Tyrannical rule. We might not ever have to use the Human Rights Act but it's there if we need it. Trouble is people only ever look at the HRA in the context of cases they don't like and fail to look at the historical context of how get to where we are now. All the rights we enjoy ? Civil Wars, rebellions and peaceful protests took place over centuries to get us where we are today.

Yes, I well remember all that tyrannical rule we had in the UK prior to 1998, I just don't know how we coped, the HRA has made all the difference.

OK, so you can't actually explain the contradiction in your claim that the Magna Carta makes charging for Employment Tribunals unlawful, but charging people to take the NHS court is absolutely fine. Glad we cleared that one up.

As far as professor Dicey is concerned, I'd rather vote for Jeremy Corbyn than read some outdated old guff from a 19th Century academic. Although I'm pleased to note that you now at least are referencing something slightly more up to date than Magna Carta.

Legal Aid was stripped to bare bones 5 years ago family law bore the brunt of cuts, bit late now to bemoan the negatives of Austerity particularly after a couple of elections, the barn door is open and doors have been taken off and burnt.
