I sent a 'demand' for an i5 processor to Flubit and they came back with a price, but for an i7
- the price was good for the i7, so I accepted it and paid.
I got a confirmation order saying it was the i7 and the next day a dispatch notice saying it was the i7 that was on the way.
When it arrived, it was the i5 - I realise I demanded the i5, but wouldn't have bought it at the price they offered the i7 at.
If I can ask, does anyone know where I stand legally?
Can I tell them they have to send me what the documentation says they had sent me (the i7)?
Basically where is the contract for the purchase formed... at the demand from me or when I accept their offer and pay (even though they offered a product that was not demanded in this case)?
I suspect the latter, but in this 'distance-selling' world are they legally obliged to send me what their documentation says they are sending me before, during and after I have paid for it?

I have emailed them and they said this:
"After opening an investigation, we can see that we have sent you the item which you originally demanded. There was an error on our part which changed the title of the item, which is why it came up as the Core i7, rather than the Core i5 - we sincerely apologise for this mistake and realise this must be frustrating for you."
- they have offered me a £10 "refund" if I want to keep the i5 otherwise a full refund if I return it. |
