This is to do with consumers rights in UK; I appreciate it will differ in other jurisdictions
So I've bought a wearable and a major fault has developed in it. The manufacturer has acknowledged the fault it is a known widespread fault in this product
In the UK the purchaser's contract is with the seller NOT the manufacturer, though in many cases the manufacturer will stand over the goods and honour the warranty
Now here is my question; article 1 was purchased and subsequently withdrawn from sale. Article 2 replaced it
So if you go back to the retailer how are they required to deal with the situation: replace Article 1 with Article 2 even though Article 2 is more expensive and has more features. Or refund your money as the item can't be fixed or deduct an amount for fair ware and tear. Any thoughts? |
