No. Never got around to doing anything about it. I had a spare ssd for win 10 pro so I got the network issue that I expected. Had WHS 2011 on the the original ssd so still using that at the mo.
I did however find the latest network card driver, but that did not work either. It does look as though it is a BIOS fault that was corrected by HP, but stock, so no extra features.

I believe the correct route is to flash BIOS back to stock, (same level as MOD BIOS) Then flash BIOS to level as indicated in the link I posted which is stock HP. There is then a MOD BIOS of the same level to get the extras back you had before. N40L BIOS MOD Guide

Thansk for the heads up, I wasn't aware of this. I'll also update to a more current BIOS version as linked.

Time to dig out my Win 8.1 disc now!

UPDATE:  WIN10 & NETWORK PORT ISSUE

I have followed this N40L BIOS MOD Guide.
Remove all drives/extra boards
Installed HP stock BIOS.
Installed MOD BIOS
From the BIOS MAIN Screen Go to
-> Chipset Menu
-> Southbridge Configuration
-> SB SATA Configuration =>
and set the following:
OnChip SATA Channel [Enabled]
OnChip IDE Type [IDE or Legacy IDE]
SATA IDE Combined Mode [Disabled] -- sets Ports 4 & 5 to use AHCI
SATA EPS on all PORT [Enabled] -- sets all Ports to be external SATA Ports
SATA Power on all PORT [Enabled]
Install Fresh Copy Of Windows 10

THIS is also a good help guide

It Works. Hope this helps people who want to go this route.

Just to confirm, by this method you kindly detail, am I able to have a fully modded bios enabling all data ports at full speed alongside my raid card with windows 10 functioning with a network card?

Or was that general instructions for updating to windows 10 (without the bells and whistles we currently have with our old moded bios)

Would sincerely appreciate your feedback

Success.
As per your instructions. However I only removed all of my usb connections, I left all hard drivesve and raid card in tact. No issues, all works a charm.

From memory i used stock FW then MOD FW to open up all extra features.
