I'm really not sure.
It appears that Homan is using their illegal entry as carte blanch justification for everything that happens to them after entry including family separation and holding in inhuman conditions.He constantly likens their actions to a traditional arrest process after which a citizen has some of their rights suspended.
AOC's argument (and that of the UN) is that illegal entry alone doesn't make them actors of illegal activity and until they have their asylum claim heard and rejected, are wholly innocent and deserve humane and respectful treatment.
